Enduring Powers of Attorney FAQs

What is an Enduring Power of Attorney?

Rather like an LPA for property and finances, an Enduring Power of Attorney (EPA) is a document appointing an ‘attorney’ giving them authority to manage the property and financial affairs of the person who created the EPA (the ‘donor’). EPAs do not cater for health/welfare.

In the case of an EPA, if the donor becomes unable to make decisions relating to their finances/property, the EPA must be registered at: https://www.gov.uk/enduring-power-attorney-duties/register-an-enduring-power-of-attorney before it can be used (or, if the EPA is already in use, it must be registered after the donor becomes mentally incapable, before it can continue to be used).

Are EPAs still valid?

Yes. Whether it is registered or unregistered, if the EPA was made before October 2007, an EPA is still valid to use.

Do I need to register an EPA?

An attorney must register an EPA if the donor loses capacity.
